The Constitution of the United States, specifically the Bill of Rights, guarantees and protects the rights of individual citizens. In addition to freedom of speech, freedom of religion, and the right to keep and bear arms, individuals have the freedom to assemble and the freedom to petition. More importantly, is the protection from unreasonable search and seizure, cruel and unusual punishment, self-incrimination, and the deprivation of life, liberty, or property without due process of law (United States Constitution, n.d.). Are these rights, however, afforded to those individuals who choose to disobey the laws of the land? Incarcerated individuals do have rights and privileges. In fact, when an individual is taken into custody, possible legal issues can arise, governmental liability surfaces, and attention must be given to the rights and privileges of the imprisoned individual. With that being said, it is important to note that while imprisonment of criminals has been a fundame ntal aspect of our country’s justice system, the methods and practices associated with it have changed over time.
